NOTICE OF CURFEW ENFORCEMENT

June 21, 2006

The Ypsilanti Police Department will begin conducting directed enforcement of the city's Curfew Ordinance. Curfew violators (minors under the age of 17 years) will be detained by police officers if they are found out in public not under the supervision of a parent or guardian between the hours of 11 p.m. and 5:30 a.m. The minor will be released to his or her parent or guardian and both the minor and the parent or guardian will receive a ticket for the curfew violation. The issuing officer will provide further details of the violation and the appearance ticket, which will require a court appearance.

Sec. 74-286. Curfew.
It shall be unlawful for any person under the age of 17 years to loiter, remain, or possess spray paint in or upon any street, alley or public place in the city between the hours of 11:00 p.m. and 5:30 a.m. of any day, unless such person is accompanied by his parent, guardian or other person having legal custody of control of such minor, or unless such minor is in the pursuit of an errand directed by his parent, guardian or other person having his care or custody, or while the performance of some lawful employment of such minor makes it necessary that such minor be upon the streets, alleys or public places during the nighttime and possessing spray paint, after such specified hours.

Sec. 74-287. Parents not to permit violation.
It shall be unlawful for any parent, guardian or other person having the legal care and custody of any minor under the age of 17 years to allow or permit any such child, ward or other person under the age of 17 years, while in his legal custody, to loiter or remain, unaccompanied, upon any of the streets, alleys or other public places in the city, within the time prohibited in section 74-286 unless there exists a reasonable necessity therefor.

Sec. 74-288. Arrest for violation.
Each member of the police force, while on duty, is hereby authorized to arrest, without warrant, any person within his presence violating any of the provisions of section 74-286 and detain such person for a reasonable time until complaint can be made and warrant issued and served. No child or minor person arrested under the provisions of section 74-286 shall be placed in confinement until the parent or guardian of such child shall have been notified and the parents' wishes or the wishes of such guardian or legal custodian ascertained, or until the parents, guardians or legal custodian shall refuse to be held responsible for the observance of section 74-286 by such minor person.

Sec. 74-289. Appearance ticket.
In lieu of arrest, any member of the police force, while on duty, may issue an appearance ticket as provided in section 96 of Act No. 147 of the Public Acts of Michigan of 1968 (MCL 764.9b, MSA 28.868(2)) for any violation of the provisions of section 74-286. Such appearance ticket shall conform to the provisions of section 11 of Act No. 54 of the Public Acts of Michigan of 1944 (Ex. Sess.) (MCL 712A.11, MSA 27.3178(598.11)). (Code 1983, § 9.184; Ord.
